These Terms and Conditions (“Agreement”) are entered into between the individual or entity (“Member”, “You”, or “Your”) accessing or using the services of GainStory (“Company”, “We”, “Us”, or “Our”).
Description of Services
The Company provides members with storytelling and content marketing services tailored to individual goals.
Eligibility and Registration
GainStory services is available only to individuals who can form legally binding contracts under applicable law. During registration, members shall provide accurate, current, and complete information as prompted by the registration process and maintain the accuracy of such information.
Payment
The Company utilizes a third-party payment processor for handling payments. Clients consent to be governed by the processor’s terms of service, in addition to this Agreement, regarding any financial transactions. Members can cancel their subscription at any time. Once a subscription is cancelled, no further charges will be applied for subsequent billing cycles.
Content and Intellectual
Property
All content, including but not limited to text, graphics, and intellectual property rights, are owned by GainStory. Redistribution, resale, or any commercial use of the content is strictly prohibited.
Termination and Suspension
The Company reserves the absolute right to terminate, suspend, or restrict your access to the services in the event of non-payment or breach of any term in this Agreement.
Delivery
Performance of Services The purchased service shall be performed or made available within the timeframe communicated prior to the signing of the contract.
Prices
Clients are informed during the purchasing process and before order submission about any fees, taxes, and costs (including, if any, delivery costs) that they will be charged. Prices on this Website are displayed either exclusive or inclusive of any applicable fees, taxes, and costs, depending on the section the client is browsing.
Contract Duration
Monthly Retainers
Paid monthly retainers begin on the day the payment is received by GainStory. These retainers cover ongoing services provided by GainStory on a monthly basis. Clients must pay the required recurring fee in a timely manner to maintain these services. Failure to do so may result in service interruptions. The scope of services covered under the monthly retainer will be clearly defined in the contract and may include services such as storytelling, story selling, social media management, SEO optimization, and other agreed-upon activities. Adjustments to the scope of work may be made upon mutual agreement and may affect the monthly retainer fee.
One-Time Project-Based
Services
Paid one-off services begin on the day the payment is received by GainStory. These services are rendered on a project basis, and the specifics of the service, including deliverables and timelines, will be clearly outlined in the contract. GainStory commits to completing the project within the agreed-upon timeframe, provided that all necessary information and cooperation from the client are received in a timely manner. Any delays caused by the client, including but not limited to delayed approvals or additional requests, may extend the project timeline and could incur additional charges.
Termination of Monthly Retainers
Monthly retainers may be terminated at any time by sending a clear and unambiguous termination notice to GainStory using the contact details provided in this document or, if applicable, by using the corresponding controls inside this Application. Terminations shall take effect 30 days after the notice of termination has been received by GainStory. During this notice period, GainStory will continue to provide services as per the agreement. Clients are responsible for any fees incurred up to the effective termination date.
Liability
The Company makes no warranties, either express or implied, about the potential outcomes from using the provided content. Members’ application of the content is at their discretion, and results are contingent on individual actions and circumstances. GainStory shall not be accountable for any indirect, incidental, or consequential damages emerging from the use or inability to use the services.
Data Protection and Confidentiality
The Company processes personal data in strict compliance with the General Data Protection Regulation (GDPR). Members have rights to their data, including access, correction, and deletion.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria and will be subject to the exclusive jurisdiction of the courts of the Federal Republic of Nigeria.
Amendments and Communications
GainStory reserves the authority to modify these terms at its discretion. Members will receive notifications and communications, including changes to this Agreement, primarily through their registered email address. Persisted usage after any changes denotes acceptance of the updated terms.
